ADA Basics for Officers
- Title III: Applies to private businesses open to the public (stores, restaurants, hotels, offices, etc.). Requires barrier removal when “readily achievable” (easy & inexpensive). No grandfathering.
- Your Role: Observe/document violations, educate, issue warnings/notices under local codes, refer to building dept./ADA coordinator.
- Key Standard: 2010 ADA Standards for Accessible Design (DOJ).
- Document Everything: Photos, measurements, business contact, disability impact observed.
Common Field Observations & Codes to Cite
1. Accessible Parking & Paths
- Insufficient spaces, no van-accessible, blocked access aisle, slope >2%, faded signage.
- No accessible route from parking to entrance.
- Cite: 2010 ADA §206, §208, §502; Local codes.
2. Entrance & Doors
- No ramp (if needed), steep ramp, door too narrow (<32”), heavy doors, no automatic opener.
- Cite: 2010 ADA §404.
3. Interior Routes
- Narrow aisles (<36”), protruding objects, blocked paths.
- Cite: 2010 ADA §403, §307.
4. Service Counters
- Counter too high (>34” forward / 36” parallel), no lowered section.
- Cite: 2010 ADA §904.
5. Restrooms
- No grab bars, narrow door, inaccessible stall, unreachable fixtures.
- Cite: 2010 ADA §603–606.
6. Outdoor/Sidewalk Issues
- A-frame signs, seating, or merchandise blocking sidewalk (<36” clear width).
- Cite: 2010 ADA §206; Local sidewalk ordinances.
7. Policies & Service Animals
- Refusing service animals or reasonable modifications.
- Cite: 2010 ADA §35.136 & §36.302.
8. Communication
- No auxiliary aids (large print, written notes, etc.).
- Cite: 2010 ADA §36.303.
